Come on, Frank. The guy shoots more than one person, tries to kill a president to impress an actress after studying up on how to do it? If it was a brain tumor, fine. It wasn’t. I’m sure there’s plenty of people here who think its better to KEEP him in the hospital then to ever let him out. From the privileges he’s received, it doesn’t sound nearly as bad as prison, even on the inside. If he was successful in killing the president, of a guard, or a reporter with the same M.O., you think he’s served enough time so we let him out? I do not believe there’s any meds to effectively counteract behavior like his.
As far as his “Ballad Of an Outlaw” shtick, he was told not to avoid media, not specifically just interviews. He’s established a fan base out of all this. I’m sorry if you disagree, but I’m not a fan of anyone who shoots guns at people and are deemed well enough to not be incarcerated, or to label him as “misunderstood”.
He’s also lucky as shit that no one died with six bullets fired. If someone died, it’d be life in prison or the ol’ DP if he killed the president.
Also, as far as the eggheads with the prescription pads go, he’s still gone a ahead tried to impress more women that he’s obsessed with. (Sorry, I’m mobile right now)

Hasn’t Hinckley already been tried for a lesser included offense? Wouldn’t this make him ineligible for a charge of murder under the double jeopardy rule?
That’s where I’m confused. He’s been sentenced and his “treatment” changed according to whatever, but that’s the only defense I can give him. Is Brady’s injuries inflicted by Hinkley really the cause of Brady’s death? And can he be tried for murder after the fact, 30 years later (as pointed out by Frank)? I don’t see how a new charge can be issued.

Prosecutors haven’t made any decision yet. This is just the medical examiner’s decision as to cause of death. I suspect other experts could be found to disagree with this conclusion.
Also think the issue preclusion issue mentioned by Gray Ghost may have some merit, but this stuff is complicated. I’d be interested to hear what Bricker thinks about it.
