Whatever, dude. I’ve been ticketed for jaywalking twice in my life, and in neither case did I ‘decide’ anything, I just acted in a safe fashion that inconvenienced no motorists (in one of the two instances, no motorists were within several blocks) that happened to involve crossing in the middle of a block or starting across the crosswalk after the ‘don’t walk’ sign had begun flashing.
I didn’t ‘decide’ to ‘break the law’, I was just getting to where I was going, minding my own business and not getting in anyone else’s way. They want to take me down to the station house under such circumstances after I’ve provided my legal name and address, then they’re being dicks about it.
But they still can’t compel me to produce an ID. They either have to accept my self-identification, or identify me by their own means.
You should check your local statutes to make sure you were actually jaywalking. Here in California, (according to the sherrif who ran the “traffic school” class I had to go to after getting a ticket, and also according to The California DMV (if I’m reading the material on that page correctly,) Jaywalking is only a violation if it takes place between “signal controlled intersections.” In other words, every intersection around the stretch of road you’re crossing has to be controlled by a traffic signal.
Another cite. This latter adds “police control” to “signal control.”
