If you say you support the right to abortion politically, yet you don’t support the legal foundation for the right, then you’re going to have to put forth another legal foundation to replace the one you don’t agree with. Because if you take away the legal foundation, the practical result will be that several states will choose to ban abortion, in which case the pro-choice crowd will be justified in concluding that you’re not much of an ally.

The remedy for covering a circumstance not covered in the constitution is to make a law or ammendment which does. A flimsy legal foundation can be eroded and taken away.

But abortion is covered under the Constitution, at least according to the Supreme Court in Roe v Wade.

If your position is that Roe v Wade was a shoddy decision, well…that may be so. But it’s the decision we have, and pro-choicers have to make do with it.

I understood JSLE completely. I thought his point was pretty obvious. He’s just wrong.

Your interpretation of the Constitution (or any law) shouldn’t depend on what you want it say. If the Constitution just flat out said “States can ban abortion if they want to”, would it still be “not pro-choice” to think Roe v. Wade was a bad decision?
