If I paint a picture of a child’s face, do I need their parent’s permission to use it in an art contest or perhaps put the painting on a website?
Also if say I won a cash prize would I be obligated to share it with the parents?
I’m thinking because it is a painting and not a photo the answer would be no to both.
Write up a simple release form before entering the artwork into the competition and have the parent sign it. Something along the lines of “By signing, parent/guardian releases artist to exhibit artwork in any forum or medium and releases any and all claims to money or other compensation or revenue generated by the artwork.”
IANAL and there may be some other language that would have to go into a release to make it all legal-like. I don’t think the form of the image makes any difference from a copyright perspective.
