Ok, here’s a hypothetical legal question that popped into my mind. Let’s say Joe has something illegal in his house. Anything could work, a stolen TV, big ole stash of drugs, or a money printing device. The cops search his house and finds one of these illegal items. In the trial, the evidence is thrown out because the cops didn’t have probable cause to search the house. What happens to the confiscated items? Do they give them back to Joe? Just wondering, thanks for any info.
If it can be identified (serial number) it would go to the person who reported it stolen. Otherwise, Joe would get to keep it. This is my unprofessional opinion.
If I were a cop under these circumstances, I’d be VERY happy to give the moron his stuff.
In the police station.
With lots of witnessess.
“So, Joe - this is your stuff?”
“Yeah, and I want it back!”
“Here ya go, dude”
“Uh, thanks, dude”
“You are under arrest…”
(Joe would have to be the dumbest fool of the year)
