And what’s wrong with that? It’s not like he gets to pick and choose. If you don’t like the penal code in your state, vote for people who will change it along the lines you want. If the penal code says that pot is illegal, it will stay that way until it’s changed. And you don’t get to pick and choose which laws in the penal code you want to obey, either.
And FWIW, I would have searched them as well. Loach and every other officer have the right to be as safe as possible in their jobs. That’s why they are allowed to do patdowns.
Because the basis for the original stop is illegal since PA only issues one plate, thus driving with only one plate is legal. catsix said the reason for the traffic stop was he was pulled over for having one plate. Fruits of the poisonous tree are thrown out. No valid PC for traffic stop, all evidence coming from said traffic stop will not be allowed.
The OP has clearly lost it (that is, assuming one may lose something one has possibly never had). The hypothetical (as in: example given for explanation of the actual issues involved) posted by Loach clearly indicates that the police officer in that example did not “pull the driver over to perform an illegal search.” He pulled him over to discuss the issue of the cracked windshield. The search resulted from an independent issue. Now, the OP may enjoy playing “Guess what I have here” with a police officer; however, I seriously doubt many, if any, others on the Planet Earth consider that a particularly enjoyable way to spend their last minutes in the realm of Reality.

So what’s the alternative here? Should we force the police to have a warrant when you get stopped for traffic infractions? What would make you folks who don’t like being stopped when you are breaking the law happy?
Me, I do pretty much what I want, keep my car in good working condition, and when I get stopped for something it’s because I’m breaking a law. I’m polite when pulled over, do what I’m told, and generally am on my way within 10 minutes because I don’t carry a concealed weapon or drugs in my car. You folks that are constantly getting stopped and harassed by “dickheads” should try it.

Thanks, we were just making sure. After the doctor trip her fever went up to 103 but then went back to normal. Nothing to do but ride it out. I was worried about strep but they ruled it out. Just one of those bugs they pick up in that disease incubator they call Kindergarten.

See also Timothy McVeigh. I pull over a lot more people than I give tickets to. If you have a minor violation but everything is in order (insurance, no suspensions, no machine guns, no blood dripping out of the trunk) I’ll let you go with a warning. Is that fishing? I guess you could call it that but it is part of the job they are paying me a pretty decent salary to do. It is not the whole job and I try to balance it out with the other responsiblities of a patrol officer. I think some officers and some departments put too much emphasis on traffic, but thats my opinion and I have heard logical arguments going the other way. FTR I write about 10-15 tickets a month which is about average on my department.

Well, Loach only writes 10-15 tickets a month, but I’m sure the number of drivers pistol-whipped or clubbed, the number of drivers arrested on false charges, and the number of drivers forced to give sexual favors in exchange for freedom, is much higher.
