According the CA.cov site, a residential rental property is uninhabitable if it doesn’t have a working heating system.
Question: Does a single fireplace in a two bedroom house with a den count as a heating system?
If so, does the rentor have an obligtion to state in the rental agreement that the fireplace is the only heat for the property?
In my state you have to have a heater in each room. My friends heat their home 99% with wood, but are required to have at least the in wall electric heaters in each room.
You are not requires to have a heater in each room. Many homes before 1960 did not have forced air heating but one or two built in heaters. I doubt that a landlord is required to state the type of heating system in the lease. but I am not sure a fireplace would quaqlify as a heating system.
