Manhattan Prosecutors file criminal charges for Trump re Stormy Daniels case - ongoing discussion here (Guilty on all 34 counts, May 30, 2024)

the sandoval decision was read into the record, and the judge is instructing the jury.

opening statements have just started. “this case is about a criminal conspiracy and a cover up.”

david pecker is expected to be the first witness

Russian TV isn’t the only one saying the one thing. Your average person’s first response to that might not be to point out that the crime was approved and charged by Trump himself against his own compatriot.

He didn’t pardon him.

Per NBC news, the Sandoval decision was:

Merchan said that if Trump takes the stand, prosecutors can bring up six determinations in four separate proceedings:

  1. Feb. 16: The N.Y. fraud case in which a judge found Trump violated law in stating the value of his assets.
  2. Oct. 28, 2022: Failing to remove an untrue personally identifying post about a law clerk on DonaldJTrump. com and was fined $5,000.
  3. Oct. 21, 2023: Intentionally violated court order by continually attacking court clerk. Fine was $10,000.
  4. The court will allow people to bring up how the defendant defamed E. Jean Carroll by making a false statement.
  5. Carroll v. Trump II: The court will allow prosecutors to bring up how a jury found Trump defamed E. Jean Carroll by making false statements with actual malice.
  6. People James v. Trump: Donald J. Trump Foundation engaged in repeated and willful self-dealing transactions.

Which is why he won’t testify. And then he’ll claim that he really, really wanted to but wasn’t allowed to.

Can we really assume that at this point, jurors will commence to dropping out in numbers? Seems that almost all that were troubled with the moment had ample opportunity to see themselves out of the jury pool.

EDIT: Responding to @Shoeless several posts up.

from CNN:

Prosecutor says jury will hear recorded call between Trump and Cohen about McDougal payment during trial

Did we know about this recording? or just suspected?

Were the recorded calls not previously used as evidence against Cohen himself?

If it’s the tape I’m thinking of, MSNBC has played parts of it. Trump says something about paying in cash, Cohen says no no no.

the defence “president trump did not commit any crimes”.

blanche says they will call trump “president trump” out of respect, a title he has earned because he was out 45th president.

So basically the defense is “Nuh-uh”?

Isn’t that always the case?

I thought the recordings I’ve heard had them all in the same room. I could be wrong, though. At least I pictured them all sitting together, but I don’t know if I read that somewhere or just assumed it was the case.

the cohen recording is as i understand it, only one recording. there are others.

side bar! so far 2 objections from prosecution. judge interrupts trump lawyer calls bench meeting.

one sustained, one overruled.

gah! if only the judge would let out the audio.

the objection that was sustained, caused the defence statement to be stricken.

So you can object to opening statements?

it is unusual, but you can object to statements in opening or closing.

another objection, another sustained, and another bench conference.

I have heard that Don Snoreleone is making another appearance!

He earned with a smart $130,000 investment.

opening statements completed.

10 minute recess. with court planned to end at 12:30pm i’m not sure if they will go with the first witness.

they are going with the first witness. david pecker is on the stand.

Just as an aside, Mr Pecker must have had a rough time in high school.

they are going through his bio. pecker is loose and he has laughed at points.

pecker is saying he had 2 emails one business and one for private things he did not want his assistant or anyone else seeing.

he is asked about dylan howard, who pecker said reported directly to him. when it came to juicy stories or over 10k in payment, howard ran those decisions by pecker.

pecker and howard are no longer in contact.

the judge has excused the jury. testimony done for today.

tuesday court will be at 11am to 2pm. the gag order will be discussed tomorrow.

pecker said “hi” to the defence table when he left the stand.
