Manhattan Prosecutors file criminal charges for Trump re Stormy Daniels case - ongoing discussion here (Guilty on all 34 counts, May 30, 2024)

Well, I’m a betting guy, and I think you’ve called it well. Right now, I’d suggest we’re at even odds that you are, but the longer Steinglass goes on, especially holding the jury’s attention as he apparently is, those could shorten.

Donald Trump has his back completely turned to prosecutor Joshua Steinglass as he’s making his closing argument.

Prosecutor Joshua Steinglass explains how Donald Trump’s personal account is an enterprise and can have falsified business records.

Trump’s personal account is “the hub of a wheel with 500 spokes” as it receives funds from Trump-owned entities and disburses funds to those entities when needed.

He says Judge Juan Merchan will instruct them as to the definition of an enterprise.

“New York is the business capital of the world, and whether you’re a private enterprise or public enterprise, you have an obligation to keep proper books and records,” Steinglass says, in effect defending the legitimacy of the charges.

Prosecutor Joshua Steinglass just asked the jury if they are good to go a little longer. Several jurors nod yes and the one who has been smiling all day smiled wider.

“All right,” Steinglass says.

The prosecutor is now talking about Michael Cohen’s relationship with Donald Trump.

“Cohen knew where the bodies were buried. It was essential to keep him loyal,” Joshua Steinglass says.

Trump’s tweets are up on the screen.

I hope this is the thing that fucks him. Way back when he was first elected (or maybe still running), a reporter asked him about his health care plan that he would have ready in two weeks, which at that point he had said more than two weeks earlier. Trump replied “I said a few weeks, I didn’t say how many weeks”. I remember thinking to myself “you’re the president and you’re playing word games/gotchas with your press corps? WTF is the matter with you?”. I’ll be thrilled to see one of his own word games being part of his undoing.

Good point. As I recall from my own jury service (that I recounted above), we did the same. “Well, it looks like we’re set to go now, but why don’t we wait until after lunch. Officer, can you call room service for us?”

Steinglass must be feeling so elated right now. I just hope he doesn’t get overconfident and overplay his hand. I don’t think he has anything to worry about, but some people could hold it against him. I’m pretty sure he’s too smart for that, but it will be hard to resist spiking the ball in the end zone.

We would get 2 restaurants from which to choose.

We had ordered lunch on the last day and we got to take it home as it arrived before we were done for the day.

I suppose it could be argued thusly… but by whom at this point?

I alway say be sure your feet are firmly in the end zone before celebrating.

Around the same time of Trump’s April 2018 tweet, Michael Cohen met with attorney Robert Costello, prosecutor Joshua Steinglass reminds the jury.

“Cohen never really trusted Costello. Can you really blame him? You saw Costello testify,” Steinglass says.

Costello told the jury “under oath” that he was only acting in Cohen’s best interest, which Steinglass calls now “a bold-faced lie.”

“Cohen wasn’t playing Costello, Costello was playing Cohen,” Steinglass says after showing the jury the email Costello exchanged with a partner in which they discussed getting Cohen “on the right page without giving him the appearance that we are following instructions from Giuliani or the president.”

“His demeanor on the stand is something you can take into account. That’s a fact when you are assessing his credibility,” Steinglass says.

Costello was an attorney who advised Cohen in the weeks following the FBI raid on Cohen’s home and office. He took the stand for the defense last week.

Judge Juan Merchan admonished Costello and threatened to remove him from the stand after he audibly complained when the judge sustained objections to the questions he was being asked.

Trump attorney Todd Blanche objects when Joshua Steinglass begins reading Michael Cohen’s testimony about his guilty plea, which includes referencing the Federal Election Campaign Act.

Before the objection, Steinglass says it’s disingenuous for the defense to tell the jurors that they should not believe Cohen because he repeatedly denied paying Stormy Daniels at all or with his own funds.

“Those lies were told at the defendant’s direction and at his behest and for his benefit” Steinglass says, with a tone expressing incredulity at the notion, calling it “chutzpah” from Trump’s legal team.

In our little California county, the attorney’s offices split the cost of the jurors’ meals. So we generally had them taken to nice places. And we had some really nice places!

Suffice it to say, after what was a one week trial, we returned a verdict a little after lunch on Friday and then I went and got a couple beers while the stress of the week hit me, at which point I went home and got thoroughly drunk and asleep by early evening.

I still find it amusing that Costello is now suing Giuliani for not paying his legal bills.

“Trump immediately went on the attack. An attack that continues to this day,” Steinglass says.

“These tweets were not only designed to punish Cohen, they were also designed to send a message to other potential witnesses,” Steinglass says, adding: Cooperate and you will face Trump’s wrath.

The jury has left the courtroom for a break.

The Trump post is from March 15, 2023, around the time Daniels was testifying before the grand jury in connection to this case.

Steinglass says Trump was “clearly trying to pressure both Daniels and (Michael) Cohen to back off.”

Trump also took legal action against Daniels in Florida to try to enforce a judgment to recover legal fees.

“True to the promises in his books the defendant wanted everyone to see the costs of taking him on,” Steinglass says.

Steinglass says the lawsuits show “the lengths he’s willing to go to punish those who dare to defy him.”

The prosecutor also displayed the Trump post, “If you go after me, I’m coming after you!!” Blanche objected and the attorneys gathered at the bench.

Trump’s lawyers have argued that this tweet was about the campaign, not Cohen or Daniels.

As the jury waited while attorneys were at the bench, Trump’s tweet remained on the screen.

'I’m not saying that was Mr. Trump’s intention to have his throngs get involved." Steinglass says.

Then adds, "But you’ll recall that Ms. Daniels testified about some of the security precautions she had to take.
