so, I’ve been on sick leave for quite a while. Really starting to feel better, though my doctor’s letter to my employer only lets me return to ‘modified duty’, which doesn’t cut it for a return to work. They want to just end my contract. That’s all well and good, because I may not be able to return to the job ever. We had a conference call about it yesterday with the HR dept as well as my two immediate line managers. My question is this: since no money was put in my account today (when I believe it should have been), are they obligated to have told me during the conference call yesterday that they put a stop payment order to the finance dept, and hence no pay today? Can they just stop paying me without telling me and leaving me high and dry with no time to find a solution?
Hopefully someone has some experience with angry employers!
I don’t do HR or employment law, but anyone here who can speak to this subject will need to know what state you’re in.
If you are a contracted worker, then the first thing you should do is read your contract. There should be clauses on incapacity and disability in there.
You don’t state why you believe you should have been paid, either contractually or under state law. It’s nice if an employer reminds you of the terms and limitations of your contract or state employment statutes before invoking them, however, it may not be a legal prerequisite to invoking them.
In short, if your benefits have simply run out, there is probably little you can do except file for SSD disability benefits or any other long-term disability coverage you may have.
I should have stated that I’m in Canada, though my contract is from the Netherlands. They expect me to come back to work soon, and have been paying, and yes, benefits should be running out. I was just wondering if anyone knows whether HR is obligated to tell me when the benefits are cut off. It’s an indefinite contract, and the the disability clause gives me a specific amount of time, and they’ve faithfully been paying me, but that specified time was up months ago. They didn’t want to lose me (that’s why I assumed they kept paying, hoping I’ll be back any day). So, would they, after our long phone call about the near future, end the cordial, upbeat phone call, and then say, Fuck Him. Put a stop payment order across the globe, but mention nothing about it on the phone.
