It bothers me the number of times I want to tell people whose lives have been thrown asunder by tragedy to just shut the fuck up. I’m sure it was terrible when your mother in law died in 1985, but give it a fucking rest.
Smart money says you spent years hugging her murderer, and mourning his death, or that the real killer was never found because the cops deliberately pinned it on some sucker.
Yes, he is going to have to face another trial. From the article:
The state Supreme Court ordered a new trial last year, citing misconduct by investigators. Carter has maintained his innocence and says a signed confession was coerced.
So it’s like they are undoing the conviction but not declaring him acquitted. I’m not familiar with this sort of procedure but I’m also not a lawyer.
Otherwise he’d still be incarcerated awaiting the trial, but instead:
Defense attorney Neal Hamilton said Carter will be placed in an extended stay accommodation near the family of his son, who was adopted by another family as an infant and didn’t learn about the conviction until years later. Carter also will need therapy to deal with his extended incarceration, Hamilton said.
ETA: I missed this bit later in the article:
Utah County prosecutor Erwin Petilos told the judge Monday that reassessing Carter’s bail was “necessary and fair” as the state continues to look at the remaining evidence in the case.
This is wrong. Raped by grandmother’s boyfriends and Mom’s boyfriends at 11 and 17. Her lawyers were stupid not bringing this into her sentencing trial.
She’s so damaged, she attempted to kill another inmate early on.
Life in prison, not execution.
I’ve read she’s requested only female guards and executioners, as a result of her PTSD. Not sure if that was granted.
