It’s my understanding that the bond only serves to stop the process of collections. The appeal can go ahead, it’s just that the plaintiff can start getting the money through repossession or other means.
I’ve been googling NYS statutes on appeals. I’m far from an expert, but I believe this is correct. It’s certainly true in places I practice. Trump can appeal without posting a bond. I do note that many articles on this case imply that the bond it necessary for the appeal, but I believe they are mistaken.
Yeah - didn’t he claim the same thing, only to post bond the next day?
This guy (and his attys) act as tho no one else has access to news media, or any memory.
One would hope.
I imagine Trump having to divert attention to liquidation of assets, and being in the news about such efforts, will adversely effect his campaign efforts.
Is this different than the E Jean Carroll suit? In that one, that was the case, wasn’t it? That the appeal can’t be started until and unless he posts the bond?
Carroll case was federal court, so the rules could be different. But even there, I’m almost sure he could have appealed without posting the bond.
“Honest Don is bravely fighting the Deep Swamp! Won’t you help? Send money today!”
One would hope.
If that’s the case, I have a fundamental misunderstanding of how that all works. I was under the impression that if he can’t come up with the bond, the appeal can’t happen. At least in part, to make sure he (or anyone in his situation) isn’t appealing to kick the can down the road.
Do the liens give a discount on the property to the lien holders? If he still owes half the value of the loan for a building, do the lienholders get to discount the purchase price by that amount? That is, if the lien holders are buying the property?
Well that’s the point. The judgment is effective immediately if no bond posted, so the can isn’t getting kicked.
It’s very rare to appeal without posting the bond, but it’s not a requirement as far as I can tell.
I would think that the lienholders would know better than anyone else what the properties were actually worth, so other bidders would look to them to see how high they value the properties. That would of course depend on the bidding process in the state of NY.
But no, they would not get a discount.
B…B…bbbbbutt…Trump has already declared that he won’t use Republican party funds to cover his legal bills.
Which means, of course, that he is already planning to loot the Republican party to cover his legal bills.
But right now, it looks like the Repubs don’t have enough cash on hand. A quick google shows only $65 million. But election season is upon us, which, like the Christmas season, is a time of giving, right? So is it realistic to assume that Trump can raid the party’s assets for the whole 500 million which he needs?
If only Trump had been able to inflate the value of his assets, perhaps one of those 30 entities would have floated his bond.
They’ve explicitly stated that was their plan, and that the voters will be happy about it.
“That is the goal over the next nine-and-a-half months. If I [Lara Trump] am elected to this position [RNC co-chair], I can assure you, there will not be any more $70,000 — or whatever exorbitant amount of money it was — spent on flowers,” she continued. “Every single penny will go to the No. 1 and the only job of the RNC — that is elected Donald J. Trump as president of the United States and saving this country.”
Personally, I’m happy to see him drain the RNC bank accounts and the bank accounts off all his supporters. If the Right, and the people on the Right are broke when this is all over, that’s their own stupid fault.
Nice to see them openly admit they have no intention of giving any money to any other Republican nominees. That they think the one and only responsibility of the RNC is to trump, speaks volumes of the vanity and narcissism inherent in this campaign.
I predict a “bloodbath” in down ballot races this year.
Stand with Trump; Fund the $355M Unjust Judgment
currently at $1.36M of the $355M goal (0.4%, on 24K donors). With that kind of promotion (title and image), I am somewhat surprised they are doing even that well. “Fund the unjust judgement” ? Who would want to fund an unjust judgement?
I am also curious about how that particular site (gfm) operates. When you donate, do you actually send money, or is it more like a pledge?
Here’s a gift link to the NY Times article about Trump’s inability to get a bond. Some choice quotes, indicating that a lot is still unanswered about what this will mean.
The case, brought by the New York attorney general, Letitia James, has posed a grave financial threat to Mr. Trump.
He might have to post an appeal bond worth more — possibly above $500 million, to reflect the interest he will owe — in order to prevent Ms. James from seizing his assets on March 25.
Under the law, Ms. James could have moved to collect from Mr. Trump as soon as Justice Engoron ruled, but she offered a 30-day grace period, until March 25. It is unclear whether she will provide Mr. Trump extra time or if she will move swiftly to collect. Nor is it clear whether the appellate court will rule on his plea for help before the deadline.
Mr. Trump could also seek to appeal to New York’s highest court, and it is unclear whether Ms. James will hold off on the seizure while he pursues that route.
A spokeswoman for Ms. James did not immediately respond to a request for comment.
Looks like we will continue to have to wait - until at least the 25th - to see if there will be any asset seizures.
