O'Connor not the swing vote on abortion

Current Justices who support the right to abortion - Stevens, Souter, Kennedy, Ginsburg, and Breyer. That is five.

It was a different court in 1990.


I am talking about all the people today saying that abortion is now at risk with a new Justice to replace O’Connor.

It should be pointed out that Kennedy is a bit of waffler on this issue. Although he agreed with the majority in Planned Parenthood v. Casey, he dissented from the majority in a later case, Stenberg v. Carhart, which struck down a Nebraska law against dilation and extraction abortions. Counting on Kennedy in an abortion case is not exactly a sure bet.

There was majority opinion is Casey. Kennedy was with the plurality.

Should say:

There was no majority opinion is Casey.


Should say:

There was no majority opinion in Casey.

did anyone notice that in Erwin Chemerinsky’s post regarding “There was majority opinion is Casey.” had the missing “no” inserted?

Did we get the power to edit, or are the mods bored enough to go around fixing our spelling errors?

No, he had a series of typos in posts #5, 6, and 7. If it had been edited there would have been a size=1 comment at the bottom of the post saying:
