With regards to how this all came about and the activists stance against the police; they need to realize that they truly are doing detriment to their cause. As another person pointed out the cops started the whole thing off talking, palms up etc…etc… this is a “no harm will come is you, so pleeez talk to us” stance.
The guy was on PCP. A terrible drug when it comes to violence.
IIRC, it was the drug used by the large fellow shooting at police in L.A. a few years back. It took more than 100 rounds of direct hits to fell the guy. I wish I had a cite…
In my opinion the police acted accordingly with the cincy guy. If anything they are listening to the higher-ups and not drawing their guns as quickly as they may have a few years ago. The activists will simply not see it that way, and it is unfortunate, because they will breed another generation of hate.
Makes sense when one takes into accout of what PCP does to a person.

And watching the raw footage so kindly provided, it’s blatantly obvoius that all they’re trying to do is get him to put his hands behind his back. They were saying it what seems like every other second. The drugs contributed to his death as much as, if not more than, anything else that happened. Once he stopped struggling, they stopped hitting him. What else do you want from them?

Amadou Diallo was shot at 41 times, but hit with 19 bullets while reaching for his wallet.

The answer is “no” and “maybe”. It depends on what state you are in.
In Wisconsin officers aren’t trained to use batons that way.
However, sometimes a use of force can fall under the heading of “untrained but justified”. I stabbed a guy in the face once with a pen because it’s all I could do at the time. Empty hand techniques weren’t working, and the guy was on top of me, preventing me from getting any other weapons out. Untrained, but justified.
Those officers just need to be able to articulate that (unless, of course, Ohio trains using a baton like that).

But I just watched that video, and I saw at least one strike to his head, and about two dozen others which were swung or thrust on-screen but which landed outside of the view of the camera.
So… what killed that husky fellow?
If the dude’s heart blew up on him while he was resisting police, fuck 'im, he had it coming. If, however, he died because the left hemisphere of his brain accidentally fell out onto the pavement while he was resisting arrest, I think the cops have some explaining to do.

I have always been one of the first people to rag on the cops. Here in Portland we have a lot of police abuse, questionable shooting etc. over the last few years. However, even with my left wing, fuck the pigs, world view, I know that taking a swing at a cop = one large economy size ass whupping. Plus if some guy weighs 400 lbs., has a heart condition and is all coked up, its not the cops that killed him.

Back in the mid-1980’s the Cincy police were called to the Greyhound bus station for some kind of fracas. Or maybe they were pursuing a suspect? At any rate, somehow they wound up in the men’s room wherein an officer’s gun was discharged, firing a “warning shot” (the officer’s words) into the groin of some poor schmo who happened to be seated at the time and apparently had no idea what was transpiring.
Well there are two new videos. One showing him dancing around the parking lot acting strange, and the other is a different view of the cops trying to take him into custody/beating the shit out of him.

Note to self: don’t do the Mr. Roboto in a White Castle if you are large and black. I don’t see what he did on video that was so threatening. He dances poorly. Were that a crime, I’d be public enemy #1. How that dancing guy ended up dead soon after that video was taken should be investigated seriously.

Good to see the SDMBers being reasonable and objective, not that it’s unusual. I agree with Derleth that the submission techniques employed could be vastly improved. One of the things I also took into consideration when evaluating the video was the relative clumsiness with which the one officer wielded his nightstick. It sounds odd and probably doesn’t mean anything from a legal perspective but it did kill any image of a strong, capable police officer just kicking the shit out of someone for kicks.
Well, just as many if not most police go through their careers without drawing, never mind shooting, their guns, maybe this particular cop never got in much ‘stick time’.
And it seems that there was a racial angle to this but it was from the dead guy to the cops–he called them “white boys” and “rednecks” right before he lunged at them, after they’d been ttrying to talk him down for several minutes already. This CNN article goes into a detailed sequence of events. Now, I think that was a trying-to-insult-in-heat-of-anger rather than a deep-seated race thing with Jones, and he’d probably have had some choice words for black cops too, but it does show a pretty belligerent state of mind before he started punching. And again, that first punch is a doozie, almost a full tackle.
His internal organs weren’t damaged by the sticks; his head wasn’t touched. His overweight, drugged-up, hypertensive body just couldn’t take the ‘excitement’ of the fight. He shouldn’t have started it in the first place–the cops weren’t going to take him in anyway, they were just trying to get him to move on.
