The alleged victim’s lawyer has dropped the case, citing that he can not verify how the empty evidence bag came into the possession of the family. The Erie Count DA will hold a press conference Friday morning.

Here’s the latest update: The tampered evidence bag was a hoax perpetrated by the alleged victim’s mother. The actual rape kit is in the possession of the DIstrict Attorney.
The other woman who accompanied the alleged victim to Kane’s house is reluctant to testify.
This case is falling apart quickly.
It’s hard to see by reading this thread why anyone would be reluctant to testify.

I’ve got no opinion of what happened in this case, but this morning I found myself wondering: if I were a wealthy young single athlete or celebrity, would I require potential sexual partners to sign a consent form?
Yeah, I realize all manner of young folk have sex all the time without assault accusations resulting. And I’m not at all intending to minimize the severity or frequency of sexual assault. But, MAN, I’m not sure I’d ever be willing to engage in a casual hook-up these days.
Presumably because none of Kane’s DNA was found on the victim in testing and the mother knew that. She would not want the court to hear that, hence the attempt to invalidate the kit by questioning the chain of custody.
The DA is now saying it’s not when the case goes to a grand jury but if.

You sign the form, and then before actual intercourse change your mind and say no. What incentive does the guy have to stop at that point? He has a contract.

“Contract” implies consideration and the intent to be bound. The form isn’t a contract. It’s not a promise of consent, it’s an indicator of consent. One would suggest that you not sign the form if the possibility exists that you might change your mind, though.
Maybe the best course would be to rely on hookers… Of course, there you’d generally have an illegal contract.
Like I said, never realized how lucky I was that I’ve always been goofy looking, uncoordinated, and far from wealthy.

There can be rape with the perp using a condom, there can be rape without ejaculation, and there can be rape using objects, so yes there can be.
How to interpret the evidence would depend on how consistent it was with the testimonies already given: what was the story he told and what was the story she told?
If both have stated that they had sex and that he put on a condom but differ only in whether or not she gave consent or was forced then the case is where it was. Well worse off given the mother’s actions. The mother’s actions cannot help but put the alleged victim in a bad light. If he denied they had sex at all and her story made no mention of a condom then the case likely does not go to trial.

At any given time there are 700 players under contract with the NHL. How many rape accusations are there? How many in all of sports? False rape accusations are hardly an epidemic. As long as you don’t actually rape anyone I think you are safe.
