Hello everyone, i was wondering if you could advise me on this.
Just the other day I was in the backyard chipping golf balls .When i turned the other way to chip them back to where i was, I was looking toward my neighbors house, where through her window I could see her changing clothes(after work I guess.) I didn’t linger to look, that’s not my bag, but it made me think. Does being in your own yard (on your property) or, say, even in your house facing a open window thru which you can look into constitute being a Peeping Tom? This is a fenced in yard im in that I’m talking about. Thanks, i’d appreciate any replies.
IIRC, From what I learned in media law class, if someone is in their living room and you can clearly see them from the street, and you take a picture, that person is in plain view and it’s pretty much like being a person standing in the middle of the street and you taking their pic (correct me if i’m wrong)
Anyway, I’d assume that you have even more right to be in your own yard and not touching any of your neighbor’s private property or making any wild effort to see her, you aren’t breaking any laws. You could even oogle her and nothing would happen, because she has left herself exposed. You’re only breaking the law if you’re standing on her property, and even then I guess the only law you’d be breaking is being on private property.

My brother-in law (ex) was walking down the sidewalk when he glanced toward a house and saw a woman standing nekkid in the front window. He didn’t dally, but she called the cops. When the cop stopped him a couple blocks away, he asked my bil (ex) 
if he had seen a woman through a window. Jerry (ex) came clean and said yes, but that she was standing there in the window. He also told the cop that he didn’t stop to watch her that he had just kept on going.
The cop arrested him anyway. The charge was later dropped, but it was pretty traumatic for him.
This happened over 25 years ago, so maybe things are different now, but I wouldn’t seek a re-run if I were you.
So, is she pretty ‘hot’.

I’m trying to find the results of this particular case. I believe it occured in Florida where one couple was having sex on the stairwell leading to the 2nd floor of their house. They were visible to their neighbors who subsequently filmed them from their own house.
Perhaps someone can find it.
I believe the outcome was that if you’re in your own back yard you can snag you lawn chair, a bag of popcorn, a video camera and enjoy the show, it’s your property and you can do as you please.
