Phil Spector: Mistrial

Wasn’t sure if this was mundane or pitworthy, so I thought I’d toss it here.

Can’t say I’m surprised. I have little faith in the California justice system. Do you think he did it? I think he’s guilty of 2nd degree. I think it was gunplay gone bad.

Can they re-try him?

Sure. Double jeopardy protections do not prohibit a retrial after a mistrial occasioned by a jury deadlock.

Will they? I think if the first jury was 10-2 in favor of acquittal, they’ll cut their losses. If it was 10-2 for conviction, I bet they’ll try again.

Do they start completely from scratch or do they use the same evidence and witnesses they’ve already compiled, with no chance of introducing additional information? I guess I’m asking if they are “blaming” the legal teams or the jury for the fuck-up. I don’t think blame is the word I’m looking for, but you get my drift.

I lean towards he’s guilty because I keep hearing about how no one has ever committed suicide under similar conditions, ever. But I guess there’s could be a first time for everything…

Just curious: what do you mean? I haven’t been following the case at all, and I actually only know about the mistrial from this thread, but I’m curious…

Supposedly no one has ever commited suicide while in the home/presence of someone who they have literally just met. I guess there are studies of when and where and under what circumstances suicides occur, and there’s never been one similar to this- per the defense. Add to it the purse on the shoulder like she was leaving, and that most who shoot themselves in the mouth supposedly don’t do it through their teeth.
