Probation and fleeing from

Let’s say that a person is convicted of a crime and is sentenced to probation. I would assume that the probation would include a number of conditions such as reporting to a probation officer, not using drugs and not leaving the area.

Here’s the question: If a person flees probation, that is runs to another state, and ignores all other conditions, how long will that person be considered an ‘escapee’. Is there a statute of limitations on such things or are you forever wanted.

Note: I know that discussions of law breaking are frowned upon, but an answer to this will settle an arguement and possible win me a wonderful foot-long sub with everything.

Sorry, wrong forum. If a mod would be so kind as to move this to GQ, I might share some of that sub.

Thanks!

Leaving the State in which the offense was commited will toll the statute of limitations. That means that while you are out of State whatever statute of limitations there may be is not running.

Also the fact that you have violated parole and continue to do so as long as you remain at large, means that no Statute of Limitations will apply. Since it can only begin upon completion of the crime. As long as you remain at large, the crime is continueing.

Isn’t a probation violation a crime in and of itself?

Then again the different states may have different statutes of limitations so no direct answer is possible unless we identify specific states.

What do I know? IANAL
