1 How would you know that the camera was being turned off? I used them and I probably couldn’t tell.
2 What would turning the camera off accomplish other than the cops getting jammed up?
I’m assuming most states and departments that have body cameras have similar, laws, rules and regulations from what we worked under. The camera must be turned on when dealing with the public in an official capacity and they can’t be turned off. The system can tell what caused them to get turned on and what caused them to turn off. It’s not like the semi-old days when there were physical tapes. The recording gets uploaded and is way beyond the capability of the cop to tamper with. Even if nothing else bad happened beyond them turning off their cameras that would be enough to jam them up.
If you mean they are going to plant evidence on you or something they would have to be really stupid because no way they get a conviction. Juries expect video. If there is no video because it was a bad angle they hate it. If there is no video because there were no cameras they are extremely unhappy. If there is no video because it was turned off or there is “malfunction” good luck getting them to hear another word. The defense will make the entire trial about the video.
