Generally speaking, in America it’s a state offense. That means at least 50 different sets of laws, not counting DC, Puerto Rico and anyplace else I’m forgetting.
Also, the term “rape” is now more of convenience for the average person than actual fact. Many states in recent years have upgraded their laws and made them genderless. So the actual charge is sexual assault. In many cases there are varying degrees of sexual assault with the law.
