The answer does remind me of something that we tend to forget in this country, the doctrine of sovereign immunity. You can’t sue California in a California court unless California lets you, either, and the same is true of the United States. The Eleventh Amendment was added to avoid the end run around state sovereign immunity that the federal courts offered. That is why you can’t just file suit against the federal government if you think a federal lawman has violated your first amendment right of freedom of speech and claim common law tort damages, for instance.
