Regarding My Bankruptcy

If you haven’t already received it, you will soon get something in the mail from the court titled “Notice of Chapter 7 Bankruptcy Case, Meeting of Creditors, & Deadlines” - right in the center of the page will be a highlighted “Meeting of Creditors” section that lists the date, time and location of the meeting.

I just came back from my 341 meeting, and it was short and sweet. It probably took me longer to get through security in the building lobby than the meeting itself. (Expect a line at the metal detector. Make life easier on yourself any those behind you and leave the brass knuckles, pocketknives, large amounts of change, “trucker” wallets with chains and anything else that the government might view as a weapon at home.)

You will need to bring your drivers license (photo ID) and your Social Security card. Start looking for it now, or go to the local Social Security office to request a replacement - it will take about two weeks to come in the mail. Be sure your drivers license is valid as well - there was a married couple who could not appear today because the husband’s license was expired and he was not even allowed to enter the building.

There will be a page of info that you need to read. Here, the page is yellow. Seeing how BK is a federal operation, it may well be yellow in all states. It’s basic stuff that you probably already know this far into the BK process, but you need to read it and you will be asked if you have read it.

When your time comes, you will approach the table and give your ID and SS card to the trustee. They’ll glance at them for about five seconds, proclaim them to be in order, hand them back, and then they’ll swear you in with a simple “Do you swear or affirm to tell the truth…”

They’ll direct you to have a seat at the table, then ask for your name and address. Did you receive a copy of the BK filing from your attorney? Did you sign it? Have you listed all of your property? Have you listed all of your debts? Are you going to keep or surrender your home?

They’re all simple questions and they’re not trying to trip you up.

They’ll ask (to the room) if there are any creditors present related to your case. If there are no creditors present, they’ll thank you and say you’re free to go. Chances are very good that there will not be any creditors, but I obviously can’t guarantee this.

Don’t fret too much over this meeting. If everything in your bankruptcy filing is true and honest, you will be able to answer the trustee’s questions without hesitation and you’ll be done before you know it.
