So apparently police are looking for who released the photos to TMZ of Rihanna’s bruises and cuts.
I’ve seen photos of battered woman before, but never thought about if they were leaked, or public record.
So in regards to the legality of the leaked photo, what law was broken? Are these types of photos public record, or are there standards in place for keeping them private?
There are a few issues here.
First is the non-legal of issue of leaking photos to the press. Police departments have strict rules about how or when to issue photos.
Certain things are part of public record, such as police blotters, but not everything in the police blotter is automatically included. Often times reporters must ask a judge to force the release of information.
There is also the additional aspect of “right of privacy.” In general celelbrities have much less expectation of privacy than regular people.
Finally there is the issue of violation of her civil rights, if there is such a violation it would be up to the DA to persue criminal aspects of that, of course she could always do a civil suit in addition.
