I don’t necessarily disagree with you, but I don’t think that the libertarian position is terribly inconsistent with the idea of personal freedom.

Suppose a restaurant said (and was allowed to say), “No honky white Republican Christians from West Virginia allowed here! Get lost!” I could vote with my wallet and tip extra at the restaurant down the road that allowed me. That would allow me to not give my hard earned dollars to someone who hates me, and I could expose the guy for the asshole that he is by publishing online how he doesn’t want “us” in his business and try to close him down.

That’s the ideal, but segregation was so institutionalized in the south as to make this free market approach impossible. That’s why I agree with Civil Rights laws that are targeted at entrenched problems. A black person in the south might have to travel a hundred or so extra miles to find a restaurant or hotel willing to serve him. That’s unacceptable.

But take sexual orientation as one example that is consistently proposed to be added to the list. How many businesses today, even in states where it is legal, openly tell gay people to get lost? ANY? Even if one did, it would make national news, and that unfortunate gay person could walk across the street and be served, and have all of the benefits of voting with his wallet as described above.

Discrimination is no longer institutionalized and protection in law is not necessary for new categories, and in time, may no longer remain necessary for the old ones..

That’s still in the future. Right now, each successive generation needs to be forced to play nice with other races, until they get old enough and/or educated enough to know about the catastrophic effects of unchecked, institutionalized racism.

Some of the ridiculously racist things that kids at my daughter’s high school say really boggle my mind. I would not have thought it possible, but i guess these kids have Aryan Nation parents at home, preaching the hate gospel. Until that stops, you have to back up racial equality with force. People are way ignorant, in more cases than you might assume. IME.

If the 1964 Civil Rights Act was repealed tomorrow, how many businesses do you think would deny service to blacks?

How many businesses currently deny service to gay people, even though it is 100% legal in most places? I’ve yet to see a single sign saying “No gay people allowed”

I’m not saying that racism doesn’t exist, but where it does the overwhelming majority of people condemn it swiftly.
