I suppose next, due to his integrity and consistency, Brownback will ask all judicial nominees who have attended a church service to recuse themselves from cases dealing with churches, such as churches who are in danger of losing their tax-exempt status. It seems Senator Sam has placed a “hold” on the nomination of a state judge from Michigan, Janet Neff, for a seat on the federal bench. Why would he do such a thing? Because Neff had the audacity to attend a Civil Union ceremony for her long-term friend and neighbor, who happened to be a lesbian. Note that there is no indication that Neff did anything more than show up to witness the event. And the kicker? It happened back in 2002.
*In Iowa on Tuesday to meet with GOP activists, Brownback said he wants only a chance to question Neff about her role in the 2002 ceremony. Brownback also wants a recorded vote in the Senate.
“I am not opposed to her getting a vote,” Brownback said before a lunch with potential donors and supporters in Davenport. “I would like her to come back through committee so she can testify what took place, factually … her legal views on same-sex marriage and her ability and willingness to be impartial.”*
By impartial, of course, Senator Fuckwit clearly means she agrees with him and opposes SSM. As an alternative, he suggests that she be required to recuse herself from all cases involving same sex marriage. I’m sorely tempted to send him a high school civics text, with the portions explaining separation of powers highlighted for his convenience. I would send him a law school text on Federal Jurisdiction, but it would go whooshing right by his empty head. The Federal Courts aren’t very likely to be deluged with an enormous number of SSM cases, seeing how marriage is generally a matter of state law. Some Judge will eventually hear a “Full Faith & Credit” case on the matter, but the issue presented is going to be whether a State must grant full faith & credit to a SSM from another State and whatever that Judge rules will be appealed before the ink has dried on the page anyway.
