Sex for donation: prostitution?

If a model/movie star/porn starlet, etc. agreed to sleep with anyone who donated money to a charity of his/her choice, would that count as prostitution?

(Answers may vary by state and country)

IMHO, yes.

Just because the money isn’t going to the person engaging in the sex act, doesn’t mean that money isn’t changing hands in exchange for a sex act.

Otherwise, pimps taking 100% would be considered a “donation” too!

How about if someone was selling condoms for $200 and they came with a free demonstration on how to use them?:stuck_out_tongue:

What if you just put out a tip jar?

NY Penal Code:

I’m assuming most other states have similar wording.

I’ve heard of several creative defenses like that over the years, and it comes down to an ‘if not for the payment there would be no sex’.

This being GQ, let’s see if we can get some more legal answers before we begin stating our opinions.

Although, for the record, I agree with you.

Isn’t that basically what escorts do?

It’s legal if you record it and sell the tape.

Capitalism, ho!

Works in computers…

I understand you are having problems with your condoms, I am so sorry for the inconvenience you are experiencing. We can have a technician out between 10pm and 2am tomorrow to assist you with getting a more satisfying condom user experience. Would you prefer your technician to be blonde, brunette, redhead, or first available.

No, they take the other tack. Pay me (not a charitable donation) just for being with you, and if we both agree (wink, wink), maybe we’ll have sex too as a completely unrelated thing.

Doesn’t the I.R.S. have enough problems without having to figure out deductions for this sort of thing?

Pun intended, I assume?

As silly as this sounds, how could the state argue against it?

Title 18 Part I Ch. 117 Sec. 2422 under Coercion and Enticement. Would be the way to get nailed. Escort or call outs similar to the Craigs List events.

Now technically. If a company hired an individual to deliver the product and you paid the company for the product, the person could get a commission for the sell and if the company had a lose ethical policy like sexual relations with customers then technically…the delivery person can decide if they want to have sex with the customer as long as they were not obligated to or mandated by their company.

No, generally, it isn’t. You can be charged with prostitution in most places if you get paid to have sex in a porno film.

That’s why all the porn companies make their films in a handful of locations. Those are the places where it’s legal.

What if they had a charity raffle with voluntary donation? Once donations reach $1,000,000 they draw a name?

We were discussing escorts, you seem to have outlined wives here…

In the UK, prostitution per se is legal. It is soliciting that is illegal, as is living off immoral earnings (although that is aimed at the pimp not the prostitute).

Apparently the lawmakers could not frame a law that included a straight transaction (You have sex with me - I pay you), but not a wife/SO/gf/bf who says " If you don’t give me more housekeeping/jewels then you are sleeping in the spare room.
