What are the emanations from the penumbra to which you are referring?
It is a reference to a comment in Justice Douglas’ opinion in the Griswold case, describing the derivation of a generalized right to privacy from the more specific recitations of the Constitution. The wording is often invoked by conservatives to deride this sort of legal reasoning. The point I was making is that Bork was (at best) using precisely this sort of handwave to derive a narrowed definition of “freedom of speech” that is nowhere to be found in the Constitutional text.
