That provision has been implemented in at least some legislation regarding so-called SLAPP suits, where false libel/defamation claims are made in order to harass the (non) offending party by tying them up in lengthy and costly litigation. If you’re found to have brought such a suit, you could wind up paying all the legal costs.
Anti-SLAPP legislation has of course also been abused.
This isn’t too surprising to me. It did seem a bit wishful thinking that everything they brought up would be non-actionable. It doesn’t in any way mean they have proof that any of their allegations are true, just that, if they were true, they would have meaning.
I still stand by the idea that the claims are false, and that the Washington Post, like everyone else, only represented what Nathan Philips had said. You can’t claim libel for simply reporting what someone said.
I also still contend that Philips wasn’t lying, and portrayed the situation as he remembered it. And that no material differences occurred in the original story and the revised version.
Unsurprisingly, we actually do have the means to identify and punish frivolous lawsuits. It’s just that apparently the actual legal folks involved with and watching this case don’t agree with your assessment. Maybe that should tell you something.
There was actual video that proved otherwise. So really, nobody was innocent in this whole stupid mess.

CNN has settled in the case brought by Nicholas Sandmann. As per usual with settlements details are not being made public.
Sandmann still has a case pending against the Washington Post and NBC Universal. Sandmann’s attorney said he intends to file a lawsuit against Gannett newspapers, the owner of the Cincinnati Enquirer.
So…200 plus little MAGA assholes were confronted by…four black Israelites. At a march for those rape fans, anti choicers for “life.” Then they harassed women. Just wearing the MAGA hat says it all.
Truly, the little rich boys who make rape jokes and worship the pussygrabber are the most oppressed people in the world.

I read this line without checking the poster’s username. I was absolutely convinced it was a sarcastic post, meant to point out how inane an idea it was. Especially with the smilies.
Then I saw the name of the poster. Then I got sad over the sheer amount of abject stupidity in the world.

The amount of the settlement hasn’t been made public, but given that the kid was suing for something like $200 million, I’d be surprised if the settlement was for less than a couple of million.
