Technically true, but the insurgents aren’t a signatory to the conventions. The U.S. is and, as such, is voilating its own laws (being that any international law that doesn’t go against an existing national law, once ratified, becomes national law). This can potentially put the U.S. in a much more difficult position than the insurgents.
