My wife had forgotten to pay a speeding ticket from Oct 2001. We have since lost the ticket. She recieved a summons in the mail stating that if the fine is not paid in the next 15 days, she may lose her license. The summons also gave the option to request a trial (delaying the revocation of driving priveleges, I suppose) and gave pertinent information, such as date of offense, nature of offense, wifes DL #, DOB, year, make, & model of car, etc. On the summons, the model year of the car (we have since gotten a different car) and her DOB are incorrect (DOB is not even close–8 1/2 years off.) Is this grounds to request a trial and have the summons dismissed? Will it even be dismissed, or will it be chalked up as “clerical error”? I am fairly certain that in PA, if an officer fails to sign the ticket or include his badge number, the ticket will be dismissed if challenged. Thoughts?
Charges have been dropped for less…but then it’s completely up to the judge. Fighting it can be a chore and a waste of a day’s pay…but it’s up to you.
Pick your battles…I’d just pay it and be glad there isn’t a warrant.
Casey1505, how much is it? Give the ticket people a call & ask them about your options. THis far along the cop might not even be on the force anymore, so you could ask himto come to court. If he doesn’t show up, you could win more easily than if he did.
Also, try your library or bookstore, they have books, e.g. Beat That Ticket, Etc that gives you the law on these things.
In PA, if the issuing officer is a no-show, the ticket is dismissed. I think we’re going to gamble. The ticket is $142 and its over, or $148 to request a trial. If we lose, ticket’s paid and we’re done. If we win, we get the $142 back ($6 court fee is non-refundable).
Not sure what we want to do. I guess this can be moved to IMHO, since I guess at this point I’m looking for opinions as to what we should do.
