A case could be made that by a strict theory of enumerated powers, the federal government has no authority to pass any gun restrictions- here’s a thread I started about that.. The question then becomes whether, like the rest of the Bill of Rights, the Second Amendment is held to recognize a fundamental right that should be incorporated under the Fourteenth Amendment. That gets into the whole topic of incorporation, but in brief the Federal government until Heller and McDonald, although repeatedly upholding the general theory of a right to keep and bear arms, was loath to interfere with state gun restrictions and found various legalistic excuses for not doing so.
Are you under the impression that the pro-gun side of the argument hasn’t won the debate? They couldn’t even pass an entirely meaningless fig leaf like the manchin/toomey bill. Urban gun control goes back to the 1920s and '30s, when “A Uniform Act to Regulate the Sale and Possession of Firearms” was adopted by many states, mandating that carry should only be by permit and rarely granted. A host of gun control acts were inspired by late 1960s crime and political violence. But gun violence by people already forbidden by law to possess firearms continues unabated, and gun control has not increased the security of the law-abiding. If we were going to eventually remove guns from American society, the gun control trend would have expanded past the 1980s instead of the reaction we see. The national push to carry and self-defense laws is comparable to America’s eventual disenchantment with Prohibition.
