He probably didn’t want to assume. I don’t recall ever seeing a tie in an individual match-up during a challenge, so I’m not sure what Jeff would do. They either sit there until someone finishes, or award no points and move on. In fairness to James, we really don’t know how long that standoff lasted; it could have been five or forty minutes, and James may have figured it’d be easier to just get it over with if he thought they weren’t going to be satisfied with a tie.
The Hidden Immunity Idol must be played after the votes are cast but before they are tallied. Therefore, the only way it influences the votes is if the holder of the Idol makes it known. In this instance, James would have wanted to keep it secret so the other three would vote for him, and his vote alone would determine who got booted, assuming he had a preference. As beautiful as it might have been to watch that trio dissolve into infighting, all things considered I believe it would have been better for James to decide himself who goes - and I think Todd’s choice of Jamie was the right one. It gets rid of the Jamie/Erik pairing and reduces both Peih-Gee and Erik to individual players in one fell swoop (I don’t think Erik would continue to support Peih-Gee in Jamie’s absence - thus exposing Zhan Hu as the granfalloon it really is).

Once you have the immunity idol, can it be taken from you by another team mate? If you’re sleeping, for example, can someone just take it if they know you have it and let go of it? Or is the rule once Burnett and company know you have it, its yours forever?
The idol cannot be taken. If you have it and you want to give it to someone else, you have to declare it in front of a cameraman (i.e. “I am now giving this idol to this person”)
Otherwise, it pretty much defeats the whole purpose of finding / earning an immunity.
Actually, I think this procedure has changed at least once. I recall a couple of seasons ago that Jeff would ask if anyone has the Idol before the vote, rather than after. I like the current setup better, much more room for surprises.
Well, who can forget last season, when Dreamz told Earl that “Mookie’s got a hidden immunity idol,” causing Earl’s alliance to switch their votes to Edgardo, Mookie to play his hidden immunity idol for nothing, and watching the “Four Horsemen’s” cocky smiles change to horror?
Believe it or not, I actually thought it was a stroke of genius. These people haven’t eaten “real” food in a few weeks, so when they actually do snarf down those “goodies,” there is bound to be trouble. And you know the first thing these soft Americans are going to be thinking is: thank God for toilet paper!
