I was channel surfing just now, and I saw two commercials – Tommy Hilfiger and Gatorade – playing simultaneously on MTV and VH1, and both were using the song “American Woman” (by Canned Heat?). Am I to assume that there is no exclusivity clause when advertizers acquire rights to use recordings?

WAG - contracts differ. You could obtain exclusive rights if you wished to pay for it.
