I was channel surfing just now, and I saw two commercials – Tommy Hilfiger and Gatorade – playing simultaneously on MTV and VH1, and both were using the song “American Woman” (by Canned Heat?). Am I to assume that there is no exclusivity clause when advertizers acquire rights to use recordings?

“American Woman” is by “Guess Who”.

[ “Guess Who?” … “Yes” … “Oh, c’mon it can’t have been ‘Yes’, WHO?” … “No, not the ‘Who’, ‘Guess Who’” … Abbot and Costello would’ve loved it ]

WAG - contracts differ. You could obtain exclusive rights if you wished to pay for it.
