This appeal was essentially about whether the plaintiffs are allowed to sue the government. Texas is a sovereign entity, and it doesn’t like getting sued in its own courts. If you want to sue Texas, your lawsuit needs to fit a category where Texas waived its sovereign immunity. Texas extends its immunity to its subparts, like the City of Houston.
When Houston and te rest of the defendants were sued, they responded by asserting that the plaintiffs allegations don’t fit in a category where Texas waived its sovereign immunity. The civil procedure in Texas says that if the government says it can’t be sued, that we need to answer that question first, and it even has special rules that make the question subject to an immediate appeal.
The case overall has a big question - what rights do same-sex couples get when they marry. And that big question gets mentioned in the Texas Supreme Court opinion, but they reminded us that this appeal isn’t about that big question.
It isn’t really difficult, yanno.

I still say “bite me” to the Texas Supreme Court for plenty of things. But I will delay this particular bite until I see where this goes, since it’s frankly confusing, being reported in various biased ways, and also I was drunk when I first posted in this thread. There was, however, a very clear statement from me that I didn’t care where he got the insurance. Now, to a rational person (like me), that statement covers a whole bunch of things:
