It’s been calmly explained to you that the Texas Supreme Court’s ruling was actually pro-SSM and yet you are flailing away at the law and at the person who explained it to you. Your posts suggest that either you can’t read, or you are being deliberately obtuse. I assume the latter is more likely.

Clearly, I said that it’s a sad state that the judicial system says, “we ruled that you have to allow gays to be able to apply for marriage licenses. . .”-----Not that the licenses MEAN the same things as they do for straight people. . .

The problem is that what you think happened isn’t what happened, but you refuse to pay attention. Yes, Obergefell controls the outcome of this case. No, the Texas Supreme Court didn’t say Obergefell doesn’t control. They said the trial court incorrectly ruled that it didn’t and told them to do it over.

There are two people primarily to be pissed off at, the two assholes who filed suit in Harris County objecting to the county providing benefits to same sex spouses. It is not like the county’s action was a grand leap in logic after the ruling in Windsor.

And I can understand some vitriol for the initial trial court. I’m not entirely clear why the case raised by these assholes was not thrown out on standing. I’m no lawyer but it seems to me that their case was a generalized grievance and that they themselves had not suffered any harm any more than any other taxpayer. The initial court should have told these assholes to suck it up buttercup, our taxes pay for things that certain people don’t like and that does not give them the right to have standing to file a lawsuit.

But for some inexplicable reason the trial court didn’t bounce the case and actually issued a stay preventing Harris County from providing benefits to same sex spouses of employees. Here, fervour, say it with me. What? The? Fuck? You assholes!
With the explanation from **AK84 **above it is now clear to me that the Texas Supreme Court was doing what it needed to do to set things right. And here is the good news… in doing so they are setting a precedent in Texas letting the all the lower courts know that the SCOTUS rulings in Windsor and Obergefell control how such bullshit cases like this one from Harris County should be dealt with.

Fervour, I feel your frustration. As someone who was out front carrying the banner in pride parades 30 years ago in the south I can see that it is hurtful that anyone would even try to question whether it is right for you and your spouse to be treated equally. The good news is that the momentum is on our side now. When the Texas Supreme Court is on our side that is a good feeling. Revel in it a bit.

I am disappointed that the Washington Post article at the top of the thread failed to provide adequate context and left readers with the wrong impression, so a hearty Fuck You Too! to WaPo on this one.
