Got it in one, thank you. (Everything else I wanted to say was already mentioned, but I just couldn’t let that particular comment go.)
Ok, thank you. I guess I had a dense moment, 'cause I couldn’t figure out what she meant. Yes, the granny was being a dumbshit. I think that’s a foregone conclusion hopefully to anyone as soon as they see the video (and I don’t feel bad for the egg she has on her face for lying, either.) I except the guy with the gun and the professional training and the paycheck signed by the government to be the “bigger” person, though. Imagine if everyone handled arguments with that kind of aggression and forced compliance. It’s not civilized in my opinion.
No problem. It’s an interesting topic.
Here’s an interesting report by the Miami-Dade Grand Jury (PDF) discussing whether tasers are responsible for causing in-custody deaths and an illuminating explanation of excited delirium syndrome.
I’m currently trying to get through a 104-page five year analysis (PDF) on suspect and officer injuries related to less than lethal weapons and use of force by Florida Gulf Coast University for the National Institute of Justice.
I do. When she said “give it to me and I’ll sign it,” he could have given it to her and let her sign it.
Agreed. Granny was ready to back down, but the trooper, by that stage, had gotten his back up, and wasn’t level-headed enough to recognize the opening and take advantage of it to defuse the situation.
Said the little asshole who still lives at home, won’t bring home a bag of groceries, won’t occasionally mow the folks’ lawn or look in on granny for them.
I don’t know if this means anything to anyone who hasn’t been in Texas recently, but I wonder if there have been any jokes tying this grandma to recent gubernatorial candiate Carole Keeton “One Tough Grandma” Strayhorn.
But then the question becomes, how many times can Granny yo-yo the officer?
“I refuse to sign”
“You’re under arrest”
“I’ll sign it”
“Ok, here’s your ticket, ma’am”
“I refuse to sign”
Repeat about 5 times, then Granny guns the accelerator. After a harrowing high speed chase, Granny can always say “I’ll sign it” to get out of the arrest again, right?
Once a cop says “you’re under arrest”, is it possible to talk your way out of it? Or when he says that, is he committed to a course of action in arresting you?
99.999999% of the time, once the officer says you’re under arrest, you’re under arrest. If he’s arresting you on a warrant and you know the warrant’s been recalled, you may get him to double check on the warrant, but generally when he or she tells you to turn around and put your hands behind your back it’s past the point of negotiation.
She had already been given multiple warnings at that point. It might be nice if the officer were to give her one more chance, but by then, I don’t think he had any more obligation to do so. He had already bent over backwards for her repeatedly, and she had repeatedly shown a refusal to cooperate.
Bingo.
You cant keep saying no no no, then yes at the last second. It didnt turn out well for that guy in Iraq a few years ago either.
Not only that, when she said it she was walking toward the road, putting both of them in a more dangerous spot.
Turn around and put your hands behind your back apparently was not an option. One poster suggests he would have had to throw her to the ground , put his knee on her back and muscle her around. That and tasering would be violent options that did not have to be used.
She was someones grandmother . What threat did she present. Did the cop think he was facing grannylady the master criminal? No, she did not respect his authority and that pissed him off.
Good Christ, I wish someone would get you another hammer.
Wow, so many great law abiding citizens here. “Go be a good example and do as your told.” “But why?”, “It’s the LAW.”
It’s not the age that matters, its the action the police officer did in response to a very minor violation.
You may argue but she was arguing with the officer and she got aggressive so it wasn’t breaking the speeding limit that got her tazed, it was that she did not comply with a dick-hole cop.
You may try to find legal justifications for doing what he did, but I think this further proves many BS laws that have to be fixed.
She refused to bond out with her signature. That’s why she went to jail. I don’t know any jurisdiction that doesn’t do it this way. It proves you received the ticket and is a binding contract to appear in court or pay the fine as a waiver. Nowhere in the video do you see the cop being a dick. Everything was explained to her. The officer did exactly what he was supposed to do. I don’t see why people object to the self-bonding process. The alternative is an automatic trip to a magistrate.
Hey, this is is Texas. Nearly everybody here is somebody’s granny by about 40 or so.
His tone of voice when he said “MOVE OVER THEIR!!!” shows his love for his own authority.
Maybe he lost his temper, ok. Still, there are many other ways to solve this issue and to assume that by not complying with the officer she WOULD have been hit by a car or caused another person harm is just playing horrible odds. 95% (or more) of the times, this does not happen.
Sure she was annoying, but I’m quite confident the guy has seen worse in his career.
Stupid laws.
She was acting like an abusive child. Frankly, I think he showed remarkable restraint and had been pushed too far.
Nobody said that she WOULD have been hit by a car or that she WOULD have hurt someone. I think you know that.
Part of a traffic cop’s job is to keep people out of the way of traffic so that they won’t get hit. Obviously, this is entirely different from insisting that they WOULD get hit otherwise.
Similarly, a cop has to ensure that these errant drivers will not cause them harm, which is why they are commanded to stay in their vehicles. Again, this is obviously not the same as assuming that these disobedient drivers WILL cause them harm. If a motorist refuses to comply, then the police officer is authorized to arrest their posteriors.
There is more than enough spirited debate on this issue. Let’s not aggravate it by misrepresenting what people have said.
