Honest question: My understanding was that the loophole the Biden administration uses to avoid enforcing the border as the law calls for is that the President has administrative discretion as to what to prioritize when there aren’t enough resources. And boy howdy, there just aren’t enough resources to enforce the border.
But if Texas is doing it themselves and the administration sues to stop them, doesn’t that invalidate the argument that it’s a resource issue? It costs the feds nothing to,let Texas control its portion of the border, and therefore eases the resource constraints elsewhere.
Am I wrong about that? Is that not the justifaction for failing to carry out the President’s constitutional requirement to defend the borders of the United States?

No, That’s not accurate. What happened is that Biden tried to get legislation put through to overhaul border security and it was rejected by Republicans in Congress. They also rejected his request for more funding to send more resources there.
On my first day in office, some of you may recall, who cover this area — and they cover it well — I sent Congress a comprehensive piece of legislation that would completely overhaul what has been a broken immigration system for a long time: cracking down on illegal immigration; strengthening legal immigration; and protecting DREAMers, those with temporary protected status, and farmworkers, who all are part of the fabric of our nation.
But congressional Republicans have refused to consider my comprehensive plan. And they rejected my recent request for an additional $3.5 billion to secure the border and funds for 2,000 new asylum personnel, another — asylum officers and personnel — and 100 new immigration judges so people don’t have to wait years to get their claims adjudicated, which they have a right to make a claim legally.
So no, the administration does not have administrative discretion, the legislature needs to make the money available because they control the budget. There’s no “loophole” being exploited despite what Fox News and others on the right might try to spin.
The fact that you were swayed by this propaganda is exactly the reason why Republicans are doing this. They can trick people into thinking Biden is at fault for all of it, that he actually wants there to be a crisis because it’s part of some plot to… I don’t know what. Steal elections again?
If you are having a problem with crime and you can’t get funding for more police officers and better equipment and training, then you can’t say that the request for more funding is “invalidated” because you’re not allowing people to engage in vigilante justice. Comic books aren’t real life, you’re not supposed to put on a mask and cape and start shooting criminals because you need to clean up the streets. Nor are you allowed to go drown immigrants because Congress won’t allow funding to properly enforce it.

The number of Border Control Agents is set by Congress although I believe they are currently under the allowed number. If they want to raise the number of agents then Congress has to approve and pay for them. Of course Agents are only one part of the process.
How the current personnel are used and what to do with those crossing the border illegally is an executive branch issue.
The problem is that Texas’s definition of an adequate job is everyone else’s definition of first-degree murder.

What does 'enforcing the border" mean? Is Mexico gonna invade? They never have (sure some bandits raided the USA). How about Canada? We were actually at war with Canada once, you know. Doesn’t that border need “enforcing? There’s no wall between france and Germany, and hell germany invaded France at least three times. They don’t 'enforce” their border.
Or do you just want to keep migrant workers out? Why? Who is gonna pick our strawberries and lettuce? Not Americans. Who is gonna clean our toilets? Where else do you get so many people willing to work dirty jobs for minimal wages- and no benefits? And pay our taxes- even tho they will never get back all the millions they pay into SocSec. The only people keeping them from being legal migrant workers is the GOP- who therefore in an amazing act of hypocrisy- have created the problem. They want to waste 20B USD keeping the same people out they hire to work in their ranches, farms and hotels.

Biden’s also placed in a rather impossible position from the courts, where he can’t tell asylum seekers to wait in Mexico until their case is heard, he can’t break up families, he can’t incarcerate children more than 72 hours and there is a five-year backlog on asylum cases.
We need serious immigration reform stat, but the Republicans really have no incentive to be reasonable, because the more messed up the system is the more they can scare America about the lawless brown hoards streaming over the border, and at the same time, as DrDeath pointed out, make money exploiting a vulnerable work force.
Republican representative Troy Nehls has as much as said they won’t support anything that might help Biden.
I’m sure he is not the only republican who feels the same. But sure, it’s all the fault of President Biden.

It’s funny how they use statistics citing an increase in drug seizures as evidence that the Biden Administration isn’t effectively patrolling the border.
And I’m pretty sure that if there was a decrease in drug seizures at the southern border, it would be cited by right-wing news outlets as evidence that the Biden Adminstration isn’t effectively patrolling the border.
It’s similar to the spin on economic policy, the right-wing media constantly cites higher prices as a result of the inflationary spike that happened a couple of years ago as evidence of a bad economy, but I promise you that if prices started to drop even slightly, they’d immediately start yelling “RECESSION”.

Yep. The only reason you hear talk of “open borders” is because it resonates. There’s a whole demographic that hears this said about Democrats, believes it uncritically, and panics.
“Open borders” has basically only ever been said once by a prominent Democrat: Hillary Clinton, in a speech in 2015. And, from context, it’s obvious she was talking about free trade, not the free movement of people.
So never campaigned for, let alone it being actual policy / law.
The only real difference is the rhetoric.
Democrat and Republican administrations do the same things for the most part, but only Republicans dehumanize immigrants and say that that they are poisoning our blood and such. That’s the difference and it’s important to some people that we not only control our border but that we also be dicks while doing it.
