I was thinking the same thing. But maybe it would be better if California or Washington or another state that really has no reason to sue. I would like to see if any of those states made in changes to their elections this year. The Blue states could sue any of them.
Yep.
The Defendents:
The Court should not abide this seditious abuse of the judicial process, and should send a clear and unmistakable signal that such abuse must never be replicated.
Considering that one of the strongest arguments against is that the states have no business interfering in each other’s elections, no, tempting as it is they probably shouldn’t.
Texas citizens, on the other hand –
Here is Michigan
Wisconsin
Georgia
That’s the point. Show where this inevitably goes.
Sue 'em for changing their laws because of the pandemic. Ya know, like why Texas is suing them.
Love the PA brief using the original meaning of “decimate.”
Upon that failure, Texas now turns to this Court to overturn the election results of more than 10% of the country. Accord, Precision Instrument Mfg. Co. v. Auto. Maint. Mach. Co., 324 U.S. 806, 814 (1945) (“[H]e who comes into equity must come with clean hands.”). Texas literally seeks to decimate the electorate of the United States.
…and “literally”.
Pennsylvania is the best one. All of them make the same exact points but PA added some snark.
Hell, sue Texas for being Texas. Makes as much sense as the Texas lawsuit.
Beats civil war.
Were Texas and the other Trumpist states to somehow be successful in this - which they won’t be, that’s not even the point of the lawsuit - what motivation would American states have to remain in a Union? What possible justification would Pennsylvania have to remain part of a country where their citizens didn’t have the right to vote for the President? They would, according to the Founding Fathers, if anything have a moral duty to secede.
The detroit response is also a good read.
So - what I find the most interesting here - and something that I would really hope SCOTUS can respond to - is that for all of the claims in the Texas filings, ALL of them appear to have been factually debunked/thrown out before. How can Texas refile them in ‘good faith’ given the plethora of prior cases.
Fuck, this scares the hell out of me more than anything else I’ve seen for a while. Not that I’m worried that the suite will succeed, but for what it represents.
Let this sink in, for more than 1/3 of the states (or nearly 2/3 of Republican states), the highest law enforcement officer in the land is willing to overturn the basis of representative Democracy for purely partisan gain. Note that this is not simply i avoiding the issue like the majority of Republicans in congress are doing, this is actively supporting his delusions. If they are willing to ignore their oaths of their office in this case, If they are willing to join this law suit, how else are they willing to put their thumbs on the scale of justice.
I had naively thought that Barr was exception, chosen by Trump for his willingness to twist and distort the law in service to partisan loyalties. But not I see that he was actually pretty much middle of the road when it came to Republican AGs.
AIUI the other states haven’t actually filed, just submitted an amicus brief. Not that that’s a good thing either.
I actually think its worse that this many states/representatives don’t understand the basic concepts of our Constitution.
Seconding. This needs to be slapped down and slapped down hard; but even presuming that it is, there’s still a hell of a problem.
This suit will be rejected and thrown out and the Electoral College will vote for Biden and then Biden will be inaugurated.
The only real damage here will be (checks notes) deep and fundamental erosion of the norms of democracy as the United States continues its slow decline in legal function and global influence.

Someone should remind me which party continuously rails against “frivolous lawsuits.” I thought it was the Republicans, but I must be mistaken. This case cries out for monetary sanctions payable to the four defendant states.
