Update on kilmar Garcia: the DOJ is currently playing dumb / ignoring the supreme court ruling. Its crazy but some analysts are saying we’re already close to a constitutional crisis on this.

So is he returned? Nope.

Abrego Garcia could be returned to the USA in under twelve hours, allowing a liberal amount of time for processing. Yet he is not back. This is the Trumpist party testing out what happens if they simply ignore the law.

Yeah, it’s dark times. They aren’t just ignoring the law but the highest court. There’s nowhere to go from here. If the DOJ continue to be belligerant we may as well burn the constitution, it’s done.

“The federal courts have no authority to direct the Executive Branch to conduct foreign relations in a particular way, or engage with a foreign sovereign in a given manner,” the DOJ attorneys wrote in the seven-page filing, arguing officials have a duty only to “remove any domestic obstacles” that may stand in the way of Abrego Garcia returning to the US.

So now what?

Trump and Bukele are in agreement that Garcia will not be returned.

Considering he was allowed to stay here for arguably BS reasons, he will never be allowed to return to the US on his own. That does not mean I agree with Trump. If SCOTUS says he should be returned then BS or not, the Executive Branch needs to undo its error and return him. That’s how our government should work. It is also a dangerous precedent. The government could deport anyone even citizens than after the fact claim to be powerless to get them back.

He’s going to die in prison is the most likely outcome

My best guess? Without the means to enforce, and with the White House realizing this, the Supreme Court will do nothing.

Trump had a similar response when Bukele first offered to jail convicted American criminals in February. “I’m all for it,” Trump said, adding that his attorney general was studying whether the idea was legally feasible. “If it’s a homegrown criminal, I have no problem, no,” he said, adding: “I’m talking about violent people. I’m talking about really bad people.”

Which I am sure will include anyone he doesn’t like.

Well, the USA is no longer a constitutional republic. That’s the first domino. Do not expect free and fair elections in 2026.

I’m trying to find something I saw on Facebook where Trump claims, among other things, that he is the “Chief Magistrate”, implying that he is the final authority on judicial matters and therefore can override any court rulings. Of course, since it was on Facebook it may be a fake. But it does sound like him.

Now that The Orange Shitbag has ignored one Supreme Court decision, the door is wide open to ignore any and all of them.

Here’s the thing about the New York Times: they say flat out “open to sending American citizens convicted of violent crimes to President Bukele’s prison.” But TRUMP says nothing about “convicted of.”

The whole point of the Abrego Garcia case is that HE HASN’T BEEN CONVICTED OF ANYTHING. That’s why the Trumpites won’t budge an inch on this: they need to establish the precedent that they can send anyone to a gulag with NO evidence, let alone conviction.

Simply say ‘he’s a criminal’ and that’s it. Every despot’s dream.

But the NYT felt it had to cover for their Trumpy-Wumpy and pretend he was ONLY going to send actually-convicted people to the concentration camps.
