The "Heat" criminals: would they all face the death penalty in California?

Not all of the participants seem to actually hit cops, but all seem to be trying to, and the scene depicts numerous cops hit and even presumably killed.

Does the participation in this extenuating circumstance give the death penalty to the DA in CA? I pretty much assume it does.

Yes, they can. In California, you can be tried for murder if anyone is killed during the process of the crime. This includes anyone the police kill, not just by the criminals, as shown in the link below.

He’s referring to the film Heat in which a group of well-dressed armed robbers, led by Robert DeNiro, engage in a cool but utterly ridiculous gun battle with cops, using bottomless magazines and fully automoatic and whatnot.
Of course, even if no-one actually gets killed during this robbery, the same gang robbed an armored car earlier in the film and killed three guards, which would certainly earn them lethal injection.

That should be “could possibly.” California rarely executes people. It’s happened 13 times since 1974. They might get a death sentence, but it would be unlikely to actually be carried out.

One thing that is very interesting about the death penalty is that using it as a possibility often will lead to a guilty plea in exchange for a life sentence. In other words if Coyote Joe, kills Martha Roadrunner, if he agrees to plead guilty he can only get life not a death sentence, through use of a plea bargain

Of course in real life a Coyote could never kill a Roadrunner :smiley:
