I listened to the entire hearing. Gorsuch, Barrett, and perhaps Roberts could join with Kagan, Brown, and Sotomayor in striking down the tariffs. Alito seemed to be asking questions just to pretend that he was being open to arguments, but it sounded performative. Kavanaugh as well. It’s really a toss-up.
I will say, the atty for the govt, U.S. Solicitor General D. John Sauer, has the world’s most irritating voice after RFKjr.

The tariff case plaintiff’s attorney, Neal Katyal, is with one of the law firms which has to pony up $100 million worth of pro bono work as dictated by the trump administration in order to have access to government buildings, etc. I wonder how much restitution this little escapade is going to cost them.
Katyal has been a regular guest on various MSNBC shows, as a legal commentator, for a number of years. He’s very sharp, and I wasn’t surprised to learn that he’s representing the plaintiffs in this case.
Yes, the two plaintiffs were instructed to combine their arguments into one, with only one of their attorneys arguing for the both of them. The other plaintiff’s attorney was equally qualified. Katyal won the coin toss (literally, that’s how they decided which attorney would argue the case). He’s argued 52 cases in front of the SC.
Didn’t one of his acolytes, the so-called governor of Texas, already threaten to place tariffs on New Yorkers coming to Texas if Mamdani wins? Yeah, you and I know the constitution prohibits that, but does the felon and his acolytes? Do they even care? Does it matter at this point? It’s not like the SCOTUS is going to stop them.

Here’s something nobody seems to be discussing much (unless I missed it). Not only is this government shutdown affecting the troops themselves, it’s also affecting the family members. Yes, I know that’s been discussed. But here’s something else to talk about. We currently have a number of active duty service members and their families using SNAP at the commissaries. The commissaries, last I heard, in the United States are closed for the duration. Overseas commissaries are not and still accept SNAP, but, of course, if there are no funds on the SNAP card, there’s nothing to accept.
