On a positive note, Americans seeking to expatriate to other countries may very well have a credible claim as asylum-seekers!

Well another very good reason could be that he’s already dead.

I would argue in this case that El Salvador is clearly and unequivocally acting as an agent of the US government.

This petson was not imprisoned for crimes committed in El Salvador or offenses against the state of El Salvador. He wasn’t arrested or detained in El Salvador and has never had a case adjudicated in El Salvador.

The only reason he’s in an El Salvadoran prison is that the government of the US is paying El Salvador to keep him there. El Salvador is their agent, they’re being paid and it’s not plausible to believe that the US has no agency in this matter.

My understanding is that even though the man was “deportable”, he was still in the US legally and only became deportable when his immigration status changed.

But deportation and incarceration are not the same thing, only one of those things deprives a person of their liberty.

If he was deported after his status changed, I probably would not personally agree with the decision but I wouldn’t think it was a gross miscarriage of justice or anything.

But to deprive an innocent person of their life or liberty, without trial, without due process, especially when there is no evidence that this person ever committed a crime, not even the crime of entering the US illegally is a gross miscarriage of justice that should outrage every American citizen…..because next time it might be you.

Anyine comparing this case to that of Britney Griner is way off base, no matter how politically motivated her incarceration might have been, she did travel to a foreign country of her own free will and got arrested for breaking the laws of that country.

The only way this would be comparable to the man being unlawfully detained in El Salvador would be if someone in the US government decided they didn’t like Britney Griner, so they forced her on a plane to Russia and paid them to hold her prisoner.

The Justice Department has placed on administrative leave a government immigration lawyer who in court this week expressed frustration at not being able to answer key questions from a judge over a mistaken deportation case, according to two people familiar with the matter.

Erez Reuveni argued the government’s case in the deportation of Kilmar Armando Abrego Garcia, who the government has said was sent to his native El Salvador due to a clerical error, despite a court order that he not be deported.

Reuveni said in court of the government’s position: “Our only arguments are jurisdictional. … He should not have been sent to El Salvador.”

Asked why the US couldn’t simply ask for Abrego Garcia’s return, Reuveni said, “The first thing I did when I got this case on my desk is ask my clients the same question,” adding that he did not get a direct answer.

Attorney General Pam Bondi took issue with how Reuveni handled the case in court.

“At my direction, every Department of Justice attorney is required to zealously advocate on behalf of the United States. Any attorney who fails to abide by this direction will face consequences,” she said in a statement to CNN.

Reuveni didn’t respond to a request for comment. On LinkedIn five months ago, he posted that he had been promoted to a new position as acting deputy director at the Office of Immigration Litigation.

Though I don’t know what was going through the minds of the Canadian border patrol, as a Canadian I am truly disgusted by what they did.

Also, in my experience, Canada is stickier about any possible work you might be doing there on a tourist visa than any other country I’ve ever entered. I’ve been quizzed several times but Canadian border authorities.

That’s not really what the court is up to. The court said not to deport this person and the government violated that order. The court is just trying to enforce its order, which just happens to involve asking another country to repatriate a prisoner.

The court isn’t saying it’s within its power to order another country to do something. Its saying, hey, administration, I ordered you not to do something, but you did it anyway. Fix that.

FWIW, the current version of Newsweek – both print and online – has no connection with the Newsweek print periodical that was part of the Washington Post’s umbrella until 2010. It’s not right-leaning like, say, Fox News … but Newsweek has kind of a pot-stirring center-right stance these days (especially online).

What are the circumstances under which El Salvador allowed these planes to land, the detainees to disembark and then be placed in this prison? Presumably there was an agreement between El Salvador and the United States. It’s ridiculous for the administration to claim now that they have no authority to do anything in El Salvador. They can go right back to the same people they spoke with earlier and ask for that guy to be returned.
