It should surprise no one that that case was cited frequently in arguments that Barack Obama was born a citizen.
Trump’s hostility to 14th Amendment citizenship is as much about ‘Birtherism’ as anything.
Trump, who is the grandson of immigrants, and the son of an immigrant.
My counter argument would be to ask if such people are not subject to the jurisdiction of the United States, are they therefore immune from arrest and prosecution?
I heard on KFI AM that Judge Hannah Dugan just got indicted for obstructing ICE in the courtroom. I’ve met some federal judges who are none to be dithered with and she seems similar in all respects.
They want to send a message. Assume she can and will file for a dismissal of the charges. Hoping very strongly that the case against her is tossed with extreme prejudice.
I wish the lawyers who drew up the complaint would be tossed with extreme prejudice.
And the husband of two others.
And whose children are sons and a daughter of immigrants.
Trump’s lawyers have argued that a judge should not wield more power than the president.
I thought the whole idea was that there were three co-equal branches of government; so the Judicial Branch – of which District judges are a part – has as much power as the President, and the Executive branch does not have more power than the other branches. At least that’s what I was taught when I was a kid. ♫ *No one part can be mor powerful than any other is. Each controls the other, you see. That’s what we call ‘checks and balances’… ♫
So yes. District judges can ‘check’ executive orders, and the Executive branch can pursue the case up to the Supreme Court. But it’s laughable that the Executive branch can just make up laws (which is the job of the Legislative branch) that cannot be checked by any part of the Judicial branch. (This just occurred to me: A District judge puts the Executive in check. The Supreme Court puts the Executive into checkmate.)
Apparently MAGA is not happy with justice Barrett:
Full Title: MAGA Melts Down After Trump-Appointed Justice Argues Against Ending Birthright Citizenship: ‘Remove This Imposter’: “Amy Coney Barrett is a disgrace and an embarrassment,” one user declared.
During oral arguments, Barrett confronted Solicitor General Dean John Sauer, who was representing the Trump administration, over his dismissive response to Justice Elena Kagan’s concerns. Barrett sharply asked whether Sauer truly believed there was “no way” for plaintiffs to quickly challenge the executive order, suggesting that class-action certification might expedite the process.
Her remarks signaled concern over restricting judicial oversight of potentially unconstitutional policies and put her at odds with both Trump’s legal strategy and his MAGA base.
Oooh…and there is more!
Full Title: Trump Trashes the U.S. as a ‘STUPID Country’ of ‘SUCKERS’ in Birthright Citizenship Rant: The president also offered the Supreme Court a very questionable history lesson about the 14th Amendment.
“Birthright Citizenship was not meant for people taking vacations to become permanent Citizens of the United States of America, and bringing their families with them, all the time laughing at the ‘SUCKERS’ that we are!” Trump wrote that morning in a Truth Social post.
“The drug cartels love it! We are, for the sake of being politically correct, a STUPID Country,” he added.
Isn’t this literally the same administration that just allowed 20 of El Chapo’s family members to come into the US?
It’s okay when a Republican does it, right?
That seems to be the rule.
I don’t understand the objection to that. His family are different people, right? Why should their relative’s crimes count against them?
Because Trump is otherwise calling people from central and South America an invasion force and bad people who commit crimes here and ruining the US. But this lot is ok? If they are ok, why not others?
Put another way, what makes this bunch acceptable versus others who want to come to the US?
When people post paywalled articles is it because they are somehow unaware they are paywalled? (Maybe they aren’t so for them?) or is it just carelessness or some sort of regional block thing?
Put bluntly: skin color and wealth, possibly also political ideology
Rich, White people with racist and fascist leanings get in under Trump. Poor, brown people of any sort, but especially those who might not be racist or fascist, don’t.
It is not paywalled for me and I do not have a subscription.
More, I put at least a snippet in the post to give a sense of the article.
I cannot tell if an article will be paywalled for someone. I do my best. This is the world we live in. If you have a solution to this please let us all know.
Thank you - I honestly didn’t know what was going on. I suspect this sort of thing may become more and more common, with region blocks and weird rules surrounding media sites.
I didn’t appreciate the snippet, thank you.
