Mostly it is about UN stuff, but I did bring up that someone challenged the current War powers bill passed by Congress as being Un-Consitutional, and the Federal Court ruled that it was legal.

Anyone remember this, anyone have a cite? Several posters posted a cite about a year ago, around the tiem of the Invasion.

Thank you.

The debate is still raging so… please?

I tracked down the cite you’re looking for. Link.

Basically, the story says exactly what I guessed in the other thread: the judge ruled that the matter was a “political question” because there was no evidence of a clear dispute between the Legislative and Executive Branches. The judge did NOT rule that the war was “legal,” he simply ruled that he must duck the question.

Choice quotes:

"BOSTON (Reuters) - A federal judge on Monday rejected a legal bid by a group of U.S. soldiers and some members of the U.S. Congress to keep President Bush from ordering an invasion of Iraq without formal congressional approval, saying the court had no business getting involved at this stage.

“U.S. District Judge Joseph Tauro ruled that a federal court can judge the war policies of political branches of government only when actions taken by Congress and the president are in conflict – a situation that does not exist today.”

Thanks, but I think there was another. I am not sure, however.
