UK Agency Work, Opting out of the conduct regulations

I am currently seeking work and have had a request from a ostensibly fairly well respected employment agency in the field I wish to work in, to put forward my CV for a position. This agency facilitates employment via a fairly complicated arrangement that I am somewhat concerned about and which I have not come across before in this industry. The agency require that you work via a separate umbrella organisation or through your own independent company, they then suggest that you opt out of the 2003 Conduct Regulations Act.

The agency involved (emphatically) advise that this is primarily an issue concerning the amount of information about the role that the contracting employer would have to supply and suggested that requiring this makes it unlikely that they would interview me for the job. I have indicated to the agency that I will not opt out of the regulations for this application but would research the issue to make a more informed decision about future applications.

My own research has indicated that the Act involves a fairly wide range of different issues although the language involved is sufficiently complex that I can’t work out the exact implications for me. I have tried contacting the government employment law helpline and they seem to indicate that opting out could adversley effect my rights and options if the job goes wrong.

This whole thing is hitting my “Danger Will Robinson” buttons pretty hard but I really can’t afford to risk chasing away perfectly good jobs in the current job market situation.

Has anyone on the board had experience of working under this arrangement?

This is an incredibly complex field, it will depend upon the skill level you are working at and the freedom you need, for instnce a very highly skilled consultant engineer might need certain freedoms to alow them to conduct other business without being tied down under restrcitive covenants - business confidentiality for example.

You are really going to need case advice, but agencies are obliged to offer these opt outs prior to entering into contracts.

Your best bet is to find others working in your field for practical advice.
