As I remarked in the Pit thread, this seems to be a theme among conservatives, even those who are anti-Trump.

It appears that there’s at least a rear plate, at least. The only image I have right now is of some conspiracy theory about the driver being a leftist, so I’m not going to link to it, but seems quite clear that there’s a license plate. Of course, just because the license plate is still attached doesn’t mean it was not premeditated. I don’t have enough information one way or the other to comment about the driver’s motives or plans, but it certainly appeared deliberate.

I will, although I suspect that my post will be attacked by people reading it as my defense of the protester’s ideology as opposed to an answer to a clear request for an explanation of the law.

The thing that I ask readers of this post to remember is that the First Amendment protects truly vile, despicable speech. My defense of the speech mentioned here is legal, not moral.

That said, the law is this: generalized incitement to violence is perfectly legal – that is, protected by the First Amendment – as long as it does not constitute a clear and present danger of imminent lawless action.

This means that a writer on the Internet who urges the murder of all Jews does not satisfy this standard. People are not moved to immediate lawless action by this statement. It’s possible that someone might, days or weeks later, commit some violence influenced by the words, but that does not criminalize the words.

Now, if we imagine a man holding a loaded gun at the head of a Jewish captive, someone present at the scene screaming at him to murder THAT Jew, we’d then be describing a clear and present danger of imminent lawless action.

Hecklers veto is an illigetimate tactic. It’s not surprising when advocating violence on political opponents is finally met with violence. Here’s the tactic for dealing with points of view one dislikes. Ignore them. Problem solved. No need to bring M80s, bike locks, or muscle cars.
