If an at-will employee gives notice of resignation in 2 weeks, and is summarily terminated prior to the passing of this 2 week period, has any crime or actionable offense been committed?
What if the employer upon receiving notice of the resignation effective date, tells the employee that unless they resign immediately, they will be terminated immediately?
I’m not an employment attorney, but I’ve heard of this happening a lot.
A lot of employers won’t want to keep someone on for two weeks knowing that they’re leaving. (Reasonable) fears include that the employee will become Mr/Mrs Slacker and not care about anything with a “What’ll they do, fire me?” attitude. Or, if they’re working with computers, a justifiable fear would be over what sorts of back-doors they could leave, data they could delete or corrupt, etc.
