The lottery system kicked in in 1969, but Stein likely would have been granted an automatic deferment from this due to law school admission. By the time of his graduation in 1970, the draft lottery had moved on to people born several years after him.
He did draw a low enough number in 1969, but again, was automatically deferred.

The first draft lottery was in December of 1969. Anyone (born between the beginning of 1944 and the end of 1950) with the draft number of 195 or lower could be drafted unless deferred. Stein’s number was 132. He was born in 1944. When he graduated from law school in 1970, that was just a few months after the lottery started. He should have been been ripe for the picking.
