While it does not directly address the OP, it is related and very enlightening. They talk to some of the, released, former prisoners, and to lawyers representing prisoners.
I was planning on starting a Great Debate on that, but was waiting for the program to become available on Real Audio. Now that it has I will be writing it tonight.
