This is the issue that faces some kiddie porn or similar defendants- they think their pictures of their nude baby in the tub are okay, but they have a choice- 99 counts and many decades in prison or plead out with no jail time and have to register.
But the fact these people are pleading out means they think their chances of winning are slight.
